Terms of Service

1. About MyNamedHorse

MyNamedHorse ("the Service", "we", "us") is an information and advertising service operated by Luke Wilkinson in the United Kingdom. The Service lets you register personal keywords (names and words that mean something to you) and sends you an alert when a horse whose name contains one of your keywords is declared to run in Great Britain or Ireland horse racing that day.

MyNamedHorse is an information service and advertising affiliate. We do not accept stakes, we do not hold customer balances, we do not place bets on your behalf, and we are not a licensed gambling operator. When you tap a "Place bet" link in the Service, you are sent directly to a third-party licensed operator's own website or app to place the bet yourself, subject to that operator's own terms.

By creating an account or using the Service, you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to use the Service. Gambling by under-18s is illegal in the United Kingdom and in Ireland. When you sign up you are asked to confirm you are 18 or older; signing up without being 18 is a breach of these Terms and grounds for immediate termination of your account.

You confirm that you are not currently registered with GAMSTOP or any other self-exclusion scheme that would prohibit you from gambling with UK-licensed operators, and that using the Service would not otherwise breach any legal obligation applicable to you.

You are responsible for ensuring that your use of the Service is lawful in your jurisdiction. The Service is intended for use by residents of Great Britain and Ireland.

3. Your account

To use the Service you need to create an account with a valid email address and a password. You are responsible for keeping your password secure and for all activity that occurs under your account. If you believe your account has been accessed without your permission, contact us at luke.fluxr@gmail.com.

You may close your account at any time by contacting us. We will delete your personal data in accordance with the Privacy Policy.

4. Your keywords

The Service matches horse names against keywords you have added to your account. You choose what keywords to add.

Keywords must not be:

• offensive, abusive, or unlawful
• the personal data of someone who has not consented to their name being stored in your account (e.g. you should not add a third party's full name without their knowledge if that third party would object)
• used in a way that infringes anyone's intellectual property or rights

We reserve the right to remove keywords that clearly breach these rules and, for repeated breaches, to suspend or terminate the offending account.

5. What the Service does and does not guarantee

MyNamedHorse reads horse racing declaration data from The Racing API, a third-party sports data provider, and matches runner names against your keywords. We provide this information on a best-effort basis.

We do not guarantee:

• that the horse data is complete, accurate, or free of errors or omissions
• that all matches will be surfaced to you, or that a horse without a match is definitely not worth betting on
• that a horse declared today will actually run (late non-runners and withdrawals happen on race morning for reasons such as vet checks and ground conditions)
• that any bet placed via a linked operator will win, be accepted, or settle as expected

The Service is provided "as is" without warranty of any kind. You use the information we provide at your own risk. Nothing in the Service is, or should be taken as, betting advice, tipping, a guarantee of winnings, or an investment recommendation.

6. Third-party operators and affiliate links

When you tap a "Place bet" button in the Service, you are redirected to a third-party licensed gambling operator (such as Betfair or Bet365). That operator, not MyNamedHorse, is responsible for:

• accepting or refusing your bet
• setting the odds
• processing any stake
• settling winnings
• their own terms, privacy policy, and responsible gambling tools

We may, in future, participate in affiliate programmes with third-party operators and receive a commission when you sign up with them through a link in the Service. As at the effective date of these Terms, the Service does not use any affiliate tracking — clicking a bet link does not generate any commission for MyNamedHorse. If this changes, we will update these Terms accordingly.

We have no control over the operators we link to and are not responsible for their products, decisions, or conduct.

7. Responsible gambling

Gambling should be for entertainment only. Never gamble money you cannot afford to lose, never chase losses, and never gamble to try to solve financial problems. If you think you or someone you know may have a gambling problem, free confidential help is available from GamCare at gamcare.org.uk and GambleAware at begambleaware.org. If you want to self-exclude from all UK-licensed online gambling operators, you can register with GAMSTOP at gamstop.co.uk.

8. Intellectual property

The Service, including its design, code, brand, and written content, belongs to MyNamedHorse. You are granted a personal, non-exclusive, non-transferable licence to use the Service for your own personal, non-commercial use. You may not copy, reproduce, scrape, reverse-engineer, resell, or redistribute the Service or any part of it.

Your own keywords and the history of your own matches belong to you. By adding keywords to your account you grant us a non-exclusive licence to store and process them solely for the purpose of operating the Service for you.

9. Account suspension and termination

We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have breached these Terms, if required to do so by law, or if the Service is being discontinued. Where practical we will give you notice and a chance to export your data.

10. Changes to the Service and to these Terms

We may update the Service, add or remove features, and change these Terms from time to time. If we make a material change to these Terms we will notify you by email or in the app before the change takes effect. Continued use of the Service after a change takes effect means you accept the new Terms.

11. Limitation of liability

To the fullest extent permitted by law, MyNamedHorse and Luke Wilkinson will not be liable for any:

• losses you suffer from placing bets with third-party operators
• loss of profit, loss of opportunity, or indirect or consequential loss of any kind
• loss arising from the Service being unavailable, slow, or showing incorrect information
• loss caused by a third-party operator's decisions or conduct

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be limited.

12. Governing law

These Terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these Terms or the Service will be subject to the exclusive jurisdiction of the courts of England and Wales, unless you are a consumer resident elsewhere in the UK or in Ireland and local consumer law gives you the right to bring proceedings in your home courts.
